Legal Notice and Terms of Use

1. Presentation of the Website

Pursuant to Article 6 of French Law n° 2004-575 of June 21, 2004 on confidence in the digital economy (LCEN), users of https://kevindb.dev are informed of the following:

• Publisher and publication manager: Kevin De Benedetti – contact@kevindb.dev
• Status of the publisher: private individual, publishing this site on a non-professional basis. As Article 6-III-2 of the LCEN allows, the publisher's identification details (name, address, telephone number) have been given to the host below and can be disclosed to the judicial authorities.

Personal data is handled as described in the Privacy Policy, whose controller is Kevin De Benedetti. No data protection officer has been appointed: this processing does not require one.

2. Purpose of These Terms and Acceptance

These terms govern the use of the site. Browsing it requires no account. Creating an account and using the AI assistant are optional and each require that you accept these terms explicitly; the assistant also has its own terms (section 8), accepted before your first message.

Creating an account is reserved for people aged 15 or over, or younger with the consent of a holder of parental authority.

3. Services Provided

The site presents Kevin De Benedetti's professional background and projects, free of charge. It offers a contact form, an optional user account and an optional AI assistant. Information is provided as a guide and kept as accurate and up to date as reasonably possible.

4. User Account

• You provide accurate information and keep your password confidential.
• You can ask for your account to be deleted at any time from your account settings; it is handled within one month.
• Access may be limited or suspended in case of abuse (attempts to bypass the site's protections, automated or excessive use, unlawful content), after notice unless the abuse calls for immediate action.

5. Intellectual Property

The site's content (text, images, graphics, logos) belongs to Kevin De Benedetti unless stated otherwise. Any reproduction, representation, modification or adaptation without prior written permission is prohibited. The source code of the projects shown remains under the licence of its own repository.

6. Liability

Kevin De Benedetti strives to keep the site available and its information accurate, but cannot guarantee uninterrupted access or error-free content. To the extent permitted by law, he is not liable for indirect damage arising from the use of the site. Nothing in these terms excludes liability for wilful misconduct or gross negligence, nor limits the rights consumers hold under mandatory law.

7. Personal Data

What is collected, why, for how long, who receives it and how to exercise your rights (access, rectification, erasure, objection, portability, complaint to the CNIL) is set out in the Privacy Policy. Contact: contact@kevindb.dev.

8. AI Assistant — Terms of Use

The chat assistant is an artificial intelligence system: its answers are generated automatically by a language model, not written by a person. It answers questions about Kevin De Benedetti's background and work. Using it requires being signed in and accepting these terms; your acceptance and its version are recorded on your account.

8.1 What the assistant is not

• Its answers may be inaccurate, incomplete or out of date. They are not professional, legal or contractual advice, nor an offer or commitment on Kevin De Benedetti's behalf.

8.2 Acceptable use

• Do not send unlawful content, nor sensitive personal data (health, political or religious opinions, etc.) about yourself or anyone else.
• Do not try to bypass the assistant's safeguards (instructions meant to make it ignore its rules, disclose its configuration or act outside its purpose), nor use it in an automated way.

8.3 Limits and safeguards

• Messages are screened before and after generation: a message flagged as harmful or as an attempt to bypass the rules may be refused.
• Use is limited per minute and per day; repeated bypass attempts reduce the daily allowance. The assistant may be temporarily unavailable.
• Conversations are processed and kept as described in the Privacy Policy (section 2.5).
• When these assistant terms change, you are asked to accept the new version before your next message.

9. Cookies

The site only stores cookies that are strictly necessary for a service you ask for, which require no consent:

• sign-in session and its security (authjs.*), set only once you sign in;
• chosen language (NEXT_LOCALE), one year;
• light/dark theme, once you change it (theme), one year;
• state of the admin side panel (sidebar_state), back-office only.

Once you start filling in the contact form of the home page without being signed in, its anti-bot check (Cloudflare Turnstile, see the Privacy Policy, section 2.4) may keep technical data in your browser, on Cloudflare's own domain, for that check alone. It is strictly necessary to send the message you are writing, and requires no consent either.

No advertising or tracking cookie is used. Audience measurement works without cookies (see the Privacy Policy, section 2.2).

10. Changes to These Terms

These terms may be updated, for instance when the site or the law changes. The date of the version in force is shown at the top of this page. Account holders are informed of any substantial change before it applies, and the assistant terms (section 8) must be accepted again in their new version.

11. Applicable Law and Disputes

These terms are governed by French law. If you are a consumer, this choice does not deprive you of the protection of the mandatory rules of the country where you live, and you may bring a claim before the courts of your place of residence. Before any legal action, please write to contact@kevindb.dev so that a solution can be sought amicably.
